Yet Another Victory for Laguna Homeowners

In August 2022, the Historic Architecture Alliance and Laguna Beach Historic Preservation Coalition filed an appeal of OC Superior Court’s Judge Randall J. Sherman’s May 2022 ruling in favor of the City of Laguna Beach and the Kirby family.

Oral arguments were heard in the California Court of Appeal, Fourth Appellate, District Division 3 on June 20, 2023

On September 9, 2023, the Court of Appeal affirmed the original judgement from over a year prior, confirming that the City of Laguna Beach acted properly in its review and approval of the Kirby’s house plans.

Perhaps not surprisingly, lawyers for the Historic Architecture Alliance and Laguna Beach Historic Preservation Coalition filed a petition for rehearing, which was also denied by the court.
